Terms of Use

The "ByeAcne" platform and brand is owned and operated by MedPilot LLC, a limited liability company. When these Terms refer to "ByeAcne," "we," "us," or "our," they mean MedPilot LLC. Your contract for services is with MedPilot LLC, not with the physicians who provide clinical care (who are independent contractors, as described in Section 7).

By creating an account or using the ByeAcne platform, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use our services. We may update these terms at any time; continued use after changes constitutes acceptance.

ByeAcne is an asynchronous telehealth platform operated by MedPilot LLC that connects patients with licensed physicians for evaluation and treatment of acne and related skin conditions. Our physicians review your photos and medical history and, where clinically appropriate, provide a treatment plan and prescription. Services are currently available in Florida and California only.

• You must be at least 18 years old to create an account and use our services.
• You must reside in a state where ByeAcne is currently licensed to provide telehealth services.
• You must provide accurate and complete information during registration and in your consultation intake form.
• ByeAcne is not for use in medical emergencies. Call 911 or go to your nearest emergency room for emergencies.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@byeacne.co if you suspect unauthorized access to your account. Each person may only maintain one active account.

ByeAcne charges a flat monthly subscription fee. Payment is accepted by credit or debit card. We do not accept insurance, HSA, or FSA payments at this time.

If your assigned physician does not respond to your consultation within 24 hours of submission, you are entitled to a full refund for that billing period. Refund requests must be submitted to support@byeacne.co. We do not issue refunds for completed consultations where a treatment plan was delivered.

ByeAcne provides access to licensed physicians but is not a substitute for in-person medical care. The physicians on our platform exercise independent professional judgment and ByeAcne does not direct or control their clinical decisions.

A prescription is not guaranteed. A physician may determine that a prescription is not clinically appropriate based on your intake information. In such cases, you will receive a clinical assessment and recommendations but no prescription will be issued.

• You may not submit false or misleading information in your intake form or account.
• You may not use the platform for any purpose other than receiving legitimate telehealth consultations for yourself.
• You may not share, resell, or transfer your account or any prescriptions obtained through the platform.
• You may not attempt to access the platform or its underlying systems by any unauthorized means.

To the maximum extent permitted by applicable law, ByeAcne and its affiliates, officers, and employees shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability to you for any claim arising out of these terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved by binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in court for intellectual property violations.
